In einem Grundsatzbeschluss stellte der Bundesgerichtshof fest, dass eine Eigentümergemeinschaft verpflichtet ist, Feuchtigkeitsschäden im Gemeinschaftseigentum zu beseitigen, wenn dadurch die Nutzung des Teileigentums an dem Gebäude beeinträchtigt wird. In dem zugrunde liegenden Fall ging es darum, ob die Eigentümergemeinschaft zur Sanierung von Feuchtigkeitsschäden in an einer im Souterrain gelegenen Decke der Geschäftsräume verpflichtet ist.

Eine Übertragung der Sanierungslast auf den Eigentümer des Teileigentums ist nur dann möglich, wenn die Teilungserklärung hinsichtlich des Gemeinschaftseigentums geändert wird. Solange dies nicht der Fall ist, ist die Eigentümergemeinschaft verpflichtet, dieses in einem solchen Zustand zu halten, dass das Eigentum von Teileigentümern nicht gefährdet ist.

Das oberste deutsche Zivilgericht machte dabei auch deutlich, dass eine Eigentümergemeinschaft eine Sanierungspflicht hat, wenn die Gebäudesubstanz gefährdet ist.
