ODR-Verordnung und Verbraucherstreitbeilegungsgesetz

EU-Verordnung Nr. 524/2013 oder ODR (Online Dispute Resolution)-Verordnung.

Seit dem 9. Januar 2016 gilt die so genannte ODR-Verordnung, nach der Online-Unternehmen unter anderem eine neue Informationspflicht gegenüber Verbrauchern haben.
Nach Art. 14 Abs. 1 der ODR-Verordnung muss ab seit 9.1.2016 ein leicht zugänglicher Link auf der Webseite eingestellt werden.

Der Informationspflicht wird entsprochen, wenn z. B. folgender Zusatz in das Impressum der Webseite des Fernunterrichtsanbieters übernommen wird:

Online-Streitbeilegung gemäß Art. 14 Abs. 1 ODR-VO: Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) bereit. Diese finden Sie unter https://ec.europa.eu/consumers/odr/

Diese Pflicht gilt unabhängig von der Betriebsgröße (anders als die Pflichten nach §§ 36, 37 VBSG, siehe die Hinweise dort). Sie betrifft alle in der EU niedergelassenen Unternehmen, die Online-Kaufverträge oder Online-Dienstleistungsverträge eingehen.

Fernunterrichtsverträge sind Dienstleistungsverträge im Sinne dieser Vorschrift. Fernunterricht wird in aller Regel im Wege des Fernabsatzes und nicht des sog. stationären Geschäftes distribuiert.

Obwohl diese Informationspflicht relativ neu ist, wurden bereits erste wettbewerbsrechtliche Abmahnungen berichtet, so dass es sich empfiehlt, das Impressum unverzüglich der neuen Rechtslage anzupassen.
