Bewertungsportale müssen Einwände prüfen

Nach einem Urteil des Landgerichts Braunschweig vom 28.11.2018 muss ein Internet Bewertungsportal prüfen, wenn die Bewertung in ihrem Wahrheitsgehalt zweifelhaft ist. Geklagt hatte ein Arzt, der von einer Person negativ bewertet worden war, die er nie behandelt hatte. Der Arzt verklagte das Bewertungsportal auf Löschung dieses Eintrags.

In seinem Urteil entschied das Landgericht, dass das Bewertungsportal als Störerin hafte. Somit stehe das Bewertungsportal in der Pflicht zu prüfen, ob tatsächlich ein Behandlungsvertrag zugrunde gelegen habe. Da das Portal die Bewertung anonym veröffentlich hatte, trage es selbst die Verantwortung für die Bewertung. Obwohl der Arzt das Portal darauf hingewiesen hatte, dass es keine Grundlage für diese Bewertung gebe, da es keine Behandlung gegeben habe, weigerte sich das Portal den Eintrag zu löschen. Nach der Meinung des Gerichts, wäre es Aufgabe des Bewertungsportals gewesen, Recherchen anzustellen und Nachweise einzuholen.

Bewertungsportale haben die Pflicht Bewertungen im Zweifelfall auf ihren Wahrheitsgehalt zu prüfen und nachweislich falsche Bewertungen zu löschen. Auch müssen die Portale nach einem Urteil des OLG München vom 13.11.2018 darauf achten, dass die Bewertungen nicht falsch dargestellt werden oder beim Leser ein falscher Eindruck entstehen kann.

Sofern Sie in einem Bewertungsportal zu Unrecht fehlerhaft oder verleumderisch bewertet werden, sollten Sie umgehend einen Fachanwalt für Wettbewerbsrecht einschalten und dagegen vorgehen.
